Reforming criminal law leads to the emergence of new or improvement existing legal institutions, which actualizes conduct thorough research. The purpose article is seen in definition author’s vision model institution release from punishment draft Criminal Code Ukraine. To achieve this goal using historical and legal, comparative, dialectical, systemic, hermeneutic other methods, we critically analyzed national foreign legislation, doctrinal provisions, highlighted proposals for Ukraine.According results study, main novelties reforming are substantiated. considerations guided by working group on development legislation formulating legislative provisions given. necessity changing terminology institute proved. expediency enshrining sub-institutions substantiated: non-sentencing; non-execution sentencing; deferral execution suspension punishment.
